Terms of Use
What you can do with the service, and what's on you.

1. Purpose
These Terms of Use ("Terms") govern access to and use of FreeKiosk Cloud, published by RUSHB (full identification in the legal notice), by anyone holding an account (the "User"), independently of the commercial terms of subscription, governed by the Terms of Sale.
Accessing FreeKiosk Cloud implies unreserved acceptance of these Terms.
2. Access and account
Access requires creating an account, attached to an organisation. Anyone creating an account must have the legal capacity to enter into a contract and must provide accurate information. An account is personal; the User is responsible for keeping their password, and their second authentication factor if they enable one, confidential.
An account can invite other members into its organisation, with distinct roles. The organisation's owner is responsible for the members they invite and the permissions they grant them.
3. Permitted use
The service is intended for the remote management of Android devices running FreeKiosk that the User or their organisation own or are authorised to administer. The User agrees to:
- not use the service for unlawful or fraudulent purposes;
- not attempt to bypass the service's technical limits (device quotas, rate limits, authentication mechanisms);
- not compromise the security or integrity of the service or of another organisation's data;
- not display, through an enrolled device, any content that is unlawful, infringes third-party rights, or is contrary to public order.
4. API keys and enrolment tokens
Each enrolled device receives an API key, and every enrolment relies on a single-use token. The User alone is responsible for keeping these safe and for any use resulting from them, including if a device is compromised.
5. Availability and maintenance
RUSHB works to keep the service available but does not guarantee continuous, uninterrupted access. Scheduled (maintenance) or unscheduled interruptions may occur. A device already configured in kiosk mode keeps running on its own during an interruption: only remote management is affected.
6. Liability
RUSHB is not liable for indirect damage resulting from use or inability to use the service, nor for the content displayed by the User's devices, which remain entirely under the User's control and responsibility. The User alone is responsible for the lawfulness of how they use the devices under their management.
7. Suspension and cancellation for breach
RUSHB may suspend or cancel a User's or organisation's access in the event of a breach of these Terms, under the conditions set out in section 9 of the Terms of Sale.
The User can delete their account at any time from the dashboard settings; this deletion is immediate and irreversible, as described in the privacy policy ("Your rights" section).

9. Changes to these Terms
RUSHB may change these Terms at any time; the version that applies is the one in force when the service is used. A substantial change will be flagged in the dashboard.
10. Governing law
These Terms are governed by French law, on the same terms as section 16 of the Terms of Sale.
